Acceptance of the Terms of Service

By using the Native Friendship Centre Of Montreal Inc. (“NFCM”) Web site (“The Service”), you agree to be bound by the following terms and conditions (“The Terms of Service”). These Terms of Service constitute the entire agreement between NFCM and You (“The Customer”) with respect to the subject matter hereof and supersede and replace all contemporaneous or prior agreements or understandings, oral or in writing, regarding such subject matter. Any waiver of any portion of the Terms of Service will be effective only if written and signed by NFCM.

Modifications to the Terms of Service

Upon notice published on NFCM Web sites, NFCM. may change or discontinue any provision of this Terms of Service agreement. Any such change or discontinuance of any provision will legally bind the Customer from the time NFCM publishes notice of the change on NFCM’s Web sites. It is the Customer’s sole responsibility to ensure that the Customer is up to date on the most current version of the Terms of Service agreement.

Modifications to the Service

NFCM reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that NFCM shall not be liable to you or to any third party for any discontinuance, suspension or alteration of the Service.

Customer’s Lawful Use

The Customer agrees to use the Service as permitted by applicable laws, including, without limitation, local, provincial, state, and national, international or any other laws. The Customer agrees that the Customer may NOT use The Service to conduct or solicit any business or activity that is prohibited by law.

No Resale of Service

You agree not to copy, duplicate, reproduce, trade, sell, resell, exploit, for any commercial purposes, any portion of the Service, use of the Service, or access to the Service.

Competent Jurisdiction

These Terms of Service will be governed by and construed in accordance with the laws of Canada, without giving effect to its conflict of laws provisions or your actual state or country of residence. If for any reason a court of competent jurisdiction finds any portion of the Terms of Service to be unenforceable, the remainder of the Terms of Service will continue in full force and effect.

Privacy Policy

Introduction

This Policy states how NFCM processes Personal Information. Personal Information is information about you that is personally identifiable like your name, address, email address, or phone number, and that is not otherwise publicly available.

Modifications to the Privacy Policy

Upon notice published on nfcm.org Web site, NFCM may change or discontinue any provision of this Privacy Policy agreement. Any such change or discontinuance of any provision will legally bind the Customer from the time NFCM publishes notice of the change on the nfcm.org Web site. It is the Customer’s sole responsibility to ensure that the Customer is up-to-date on the most current version of our Privacy Policy agreement.

Information Collection and Use

NFCM collects personal information about you only when you knowingly and willingly provide it, and we will not share or otherwise profit from the distribution of personal data beyond the use it was provided to fulfill. The knowledge and consent of the Customer are required for the collection, use or disclosure of Customer information, except where inappropriate. The collection of Personal Information is limited to what is required for the purposes identified by NFCM.

Information Sharing and Disclosure

When you leave any Personal Information on our Web site, you can be assured that our company is the only one who will use it. We do not rent, sell, or otherwise distribute any information from our Customer database.

Emails we receive from you

When you send us an email you provide us with your name, email address and any other information you provide in the body of your email. This information may be shared with persons outside NFCM if and only if they are required to receive this information in order to respond effectively to your query. NFCM retains all email correspondence indefinitely.

Emails you receive from us

Your email address, if you provide one, is stored in our Customer database.  If you leave the email address blank, or erase it, you will NOT receive any more email from us. If you provide a valid email address, it will always be used to communicate with you, when and only when necessary.

Credit Card Information

For obvious security reasons, we do NOT save your credit card information.  Soon after your transaction completes, regardless of whether it succeeds or fails, the credit card information is deleted from our system. This ensures that your credit card information is not at risk if our server were to be defective, hacked or otherwise compromised.

This Web site contains links to external Web sites. Please be aware that NFCM is not responsible for their privacy practices. Please also be aware when you leave our site, and read the Privacy Policy of each and every Web site that collects Personal Information. This Privacy Policy applies solely to Personal Information collected by this Web site.

Cookies

Cookies are pieces of information about your system and your browser. They are commonly used to remember returning visitors, record their preferences, shopping cart, registration information, pages viewed or items purchased. Cookies do NOT collect any personal data about who the cookies are served to. When you use our Web site, our server might use a session cookie for storing temporary information. Such a cookie is only tied to the session in progress and is deleted when the session is terminated. If your browser is set up to reject cookies, then you might be unable to use some features of our Web site.

Server Logs

Our Webmaster uses IP addresses, dates, times, objects names and sizes to analyze traffic and administer the site. IP addresses are linked to Personal Information for security and diagnostic purposes.

Limitation of Liability

NFCM takes serious precautions to protect its Customers’ information both on-line and off-line. Personal Information is stored on servers in a secure environment. These servers are protected from hackers with robust security mechanisms and procedures. Only our employees or contractors have access to this information, if and only if they have signed a non-disclosure agreement and have been trained on our privacy practices. In spite of that, we want you to be aware that perfect confidentiality and security is not yet possible over the Internet. Information transported over the Internet is subject to interception, loss and alteration. On whichever site you provide Personal Information, it is possible for a third party to view that information. This is why messages posted to newsgroups have resulted in unsolicited email from spammers. You acknowledge and agree that NFCM shall not be responsible for any damages you may suffer as a result of the transmission of confidential or sensitive information over the Internet, and that all such communications will be at your own risk.
